Terms and Conditions

These Terms and Conditions govern all tours, treks, itineraries, and travel services provided by Llama Path. By paying a deposit or booking any service with Llama Path, the Client agrees to be bound by these Terms and Conditions.

1. Definitions

   Client: Any person who books a trip with Llama Path, including all participants included in the booking.
   
   Day Tour: Any trip offered by Llama Path lasting one day only.

   Deposit:

   • For Treks: USD $300 per participant, per trek.
   • For treks including Wayna Picchu Mountain or Machu Picchu Mountain: USD $385 per participant.
   • For Peru itineraries or multi-day non-trekking trips: 50% of the total trip cost.

   Please note that PayPal or Visa transaction fees (approximately 4.5%) must be covered by the Client.

   Llama Path: Llama Path, a licensed tour operator based in Cusco, Peru, including its employees, guides, representatives, and associated partners.

   Peru Itinerary: A multi-day trip where trekking is not the primary activity.

   Trek: Any trip where trekking is the main activity.

   Trip: Any tour, trek, itinerary, or travel service offered by Llama Path.

2. Acceptance of Terms
   The Client agrees to these Terms and Conditions upon payment of the required deposit.
3. Prices
   Prices published on the Llama Path website or provided directly by Llama Path are subject to change without prior notice due to social, political, economic, operational, or governmental factors.

   All prices are based on double occupancy accommodation unless otherwise stated. Additional charges may apply for single accommodations.

4. Deposits and Payments
   Once a deposit is received, Llama Path immediately secures permits, entrance tickets, transportation, accommodations, and related services through the Peruvian government and third-party providers.

   Deposit payments may be made through:

   • PayPal
   • Visa payment link available on the Llama Path website

   The remaining balance must be paid as follows:

   • Treks and Day Tours: No later than 48 hours before the start of the tour.
   • Peru Itineraries and multi-day trips: No later than two weeks before the trip begins.

   Payments in Cusco may be made in USD cash or Peruvian soles using the exchange rate of the day.

5. Group Size Adjustments
   In the event that one or more participants cancel from a private group, the final tour price may be recalculated based on the final number of participants attending the trip.
6. Student and Minor Discounts
   Discounts may apply to:
   • Students aged 25 years or younger
   • Participants under 18 years old

   Students must provide a valid university identification card at the time of booking and present the original physical card upon arrival in Cusco.

7. Transfers
   Deposits and bookings are strictly non-transferable. They cannot be transferred to another person, date, or tour.
8. Cancellation and Refund Policy
   All deposits are non-refundable and non-transferable.

   For treks and tours requiring government-issued permits, permits are non-refundable and non-transferable under Peruvian government regulations.

   For Peru itineraries and multi-day trips, deposits are used immediately to secure hotels, transportation, tours, train tickets, entrance tickets, and related services, and therefore cannot be refunded.

   If a Client cancels a trip after full payment has been made, certain components such as entrance tickets, train tickets, or bus tickets may still be usable depending on provider policies.

9. Alterations by Llama Path
   Travel in Peru may require flexibility due to weather conditions, strikes, road closures, government regulations, or other unforeseen circumstances.

   Llama Path reserves the right to modify itineraries, schedules, routes, transportation, accommodations, or trip operations when necessary for safety, operational, or logistical reasons.

10. Force Majeure
    Llama Path shall not be liable for delays, alterations, cancellations, losses, or additional expenses caused by events beyond its reasonable control, including but not limited to:
    • Natural disasters
    • Extreme weather
    • Strikes or protests
    • Political unrest
    • Government actions
    • Pandemics or disease outbreaks
    • Transportation interruptions
    • Acts of terrorism or war
11. Protests and Strikes
    In the event of protests, strikes, or transportation disruptions, Llama Path may modify departure times or itineraries to ensure the best possible operation of the trip.

    Additional operational costs caused by such circumstances may be charged to the Client.

12. Holiday and Election Surcharges
    Trips operating during Peruvian national holidays or election dates may incur an additional surcharge of approximately USD $35 per person.

    This surcharge helps cover operational costs, staff bonuses, and election-related penalties.

13. Evacuations and Emergencies
    If a Client requires evacuation due to illness, injury, altitude sickness, or any other emergency, all transportation, medical, rescue, and related costs shall be the sole responsibility of the Client.

    Clients agree to follow all decisions made by Llama Path guides regarding safety and evacuation procedures.

14. Travel Insurance
    Llama Path strongly recommends that all Clients purchase comprehensive travel insurance covering:
    • Trip cancellations
    • Medical emergencies
    • Delays
    • Evacuations
    • Lost or damaged baggage
    • Personal liability
15. Risk Acknowledgment
    The Client understands that adventure travel and trekking involve inherent risks, including but not limited to:
    • Altitude sickness
    • Accidents
    • Weather-related hazards
    • Physical exertion

    Participation is voluntary, and Clients accept full responsibility for risks associated with the trip.

16. Guide Authority
    Llama Path guides have full authority regarding operational and safety decisions during the trip. Clients agree to follow guide instructions at all times.
17. Client Responsibilities
    Clients are responsible for:
    • Arriving adequately prepared physically and mentally
    • Bringing suitable equipment and clothing
    • Informing Llama Path of medical conditions or dietary requirements
    • Complying with Peruvian laws and regulations
18. Passport and Visa Requirements
    Clients must ensure:
    • Their passport is valid for at least six months from the date of entry into Peru
    • They comply with all visa and immigration requirements applicable to their nationality

    Llama Path is not responsible for denied entry into Peru.

19. Acclimatization
    Llama Path strongly recommends that Clients spend at least three days in Cusco or another high-altitude location before beginning any trek to reduce the risk of altitude sickness.
20. Equipment Rental and Porters
    Additional charges apply for equipment rentals and extra porter services.

    On the Inca Trail, porters carry camping equipment only. Personal items, sleeping bags, and sleeping mats remain the responsibility of the Client unless an extra porter is hired.

21. Limitation of Liability
    To the maximum extent permitted by law, Llama Path’s total liability shall be limited to the amount paid directly to Llama Path by the Client.
22. Third-Party Operators
    For tours outside Cusco, Llama Path may operate through trusted partner companies selected for their quality and experience.
23. Reservation Confirmation
    Clients must confirm their reservation at least 24 hours before the start of the tour, as required by local authorities and operational procedures.
24. Governing Law
    These Terms and Conditions are governed by the laws of Peru. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Peru.
